WASHINGTON, D.C. (WordNews.org) June 24, 2022 — The U.S. Supreme Court just handed down its decision in Dobbs v. Jackson Women’s Health case in a ruling 6-3 that will forever be known as the overturning of Roe v. Wade, which legalized abortion nationally.
The court ruled “that Roe and Case must be overruled.”
“This case will forever be known as the one that reversed Roe v. Wade,” said Kristan Hawkins, president of Students for Life, noting that she’d been “dreaming of this day since I was a teenager.”
Today the U.S. Supreme Court, in the Dobbs case, upheld Mississippi’s law banning abortion after 15 weeks of pregnancy.
In his opinion, Justice Samuel Alito wrote: “We end this opinion where we began. Abortion represents a profound moral question. The Constitution does not prohibit the citizens of each State from regulating or prohibiting abortion. Roe and Case arrogated that authority. We now overrule those decisions and return that authority to the people and their elected representatives.”
Case refers to the 1992 Planned Parenthood of Southeastern Pennsylvania v. Case decision. Joining Alito were Justices Clarence Thomas, Neil Gorsuch, Brett Kavanaugh and Amy Barrett. Chief Justice John Roberts wrote that he would have taken a “more measured course” rather than overturn Roe v. Wade, extending the right federally to get an abortion “far enough to ensure reasonable opportunity to choose” and yet “not extend any further.”
The court’s three liberal justices, Stephen Breyer, Sonia Sotomayer and Elena Kagan, issued a dissenting opinion
Anti-abortion groups praised the ruling, with some, like Stanton Healthcare in Meridan, Idaho, planning press conferences. Stanton Healthcare called the ruling a “watershed moment in American history for human rights, justice and ending abortion violence.”
In an email to supporters, Stanton Healthcare noted that “overturning Roe is not a finish line, but rather a starting line for the pro-life community to move forward state by state to make abortion unthinkable. The pro-life community rejoices (that) abortion will end up on the scrapheap of history like chattel slavery and segregation.”
“As an advocate for women, human rights and justice, I am thrilled the tragic history of abortion violence in America, created by Roe v. Wade, is ending,” said Brandi Swindell, founder and CEO of Stanton Healthcare. “Our nation is now embracing the truth that unfettered access to abortion for the full nine months of pregnancy does not uplift women or advance justice and equality.”
Liberty Counsel, in a news release, said: “There is nothing in the Constitution about abortion, and the Constitution does not implicitly protect the right. In fact, the Constitution protects the fundamental right to life, which was enshrined in the Nation’s birth certificate – the Declaration of Independence. The Court holds that ‘It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.'”
Justice Thomas wrote separately his view that the due process clause also does not protect a right to an abortion.
“As I have previously explained, ‘substantive due process’ is an oxymoron that lacks any basis in the Constitution.” Indeed, “[t]he notion that a constitutional provision that guarantees only process before a person is deprived of life, liberty, or property could define the substance of those rights strains credulity for even the most causal user of words.”
The 16,000-member Christian Medical & Dental Associations (CMDA), which is the nation’s largest faith-based professional healthcare association, praised the U.S. Supreme Court’s decision “effectively ending the constitutional right to abortion in the United States.”
“This is a much-needed victory for life and for healthcare. And, most importantly, it is a much-needed victory for the dignity of our patients and their unborn babies,” said CMDA Senior Vice President of Bioethics and Public Policy Jeff Barrows, DO, MA (Ethics), who is an OB/Gyn physician.
“Roe is dead,” said Mark Harrington, president of Created Equal, a national anti-abortion organization that focuses on training individuals by using a traveling photo exhibit to show what abortion does to pre-born children. “A new era of the abortion battle has now begun. By meeting the needs of abortion-vulnerable parents and continuing to change public opinion, we are ready for the challenge of a post-Roe America.”
Operation President Troy Newman Roe v. Wade has resulted in the deaths of more than 63 million in the womb.
“For the first time in nearly 50 years, Roe is no longer the law of the land. A great injustice has been corrected, and that gives us new hope for our nation and a reason to rejoice,” Newman said. “Half the states will now become abortion free and millions of innocent lives will be spared from the barbaric practice of abortion. This is a human rights victory beyond all others and justifies the decades of tireless work by selfless pro-life individuals and organizations, including Operation Rescue, which have worked and prayed for decades for this day.”
Tim Wildmon, president of the American Family Association, added: “We are praising God that the Supreme Court has overturned Roe v. Wade and is sending abortion regulation back to each respective state. AFA will continue to fight to ensure each state abolishes abortion.”
In a note to supporters, Susan B. Anthony Pro-Life America’s Marjorie Dannenfelser, sent a blast to supporters: “We achieved the impossible. Friends, i cannot believe I typed those words. I’m crying tears of joy thinking of the millions of babies who now have the chance to live. But we cannot forget that our fight is not over. The issue of abortion willow be brought to all 50 states in America, and we need your help fighting to ensure that LIFE wins across the nation.”
The National Black Pro-Life Union’s Day Gardner issued the following statement: “Roe is gone! Giving thanks for the long awaited decision of the Supreme Court to finally right their wrongly decided law. Also praising God for my colleagues, each and every person, group and organization who have worked and lobbied for almost 50 years to stop the bloody slaughter of innocent children. History has ben made today and now our attention must be focused on the individual states.”
Penny Young Nance, president and CWO of CWA Legislative Action Committee, called today’s decision a “huge victory for human rights and life.”
“Concerned Women for America has been working towards this decision for almost 50 years,” she said. “In 1973, the Roe v. Wade decision by the U.S. Supreme Court made it legal to destroy life, a child, in the womb up to birth. In 2022, the Dobbs decision has allowed the conversation to begin again about what we, as a society, now know about fetal development and what restrictions should be placed on destroying human life in the womb.”
